I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -
1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?
Please Help...

I am currently in the US on H1B and want to pursue higher studies. Can someone please let me know the supporting documents that are required for COS.

My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?
Nope...she has to start with Labor and apply for a 140 in either EB3 or EB2 categories. Only L-1A visa holders are eligible to skip labor and apply in the EB1 category.

Hello All,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

The USCIS, on May 18, 2009, once again provided an update on the number of filings for H-1B petitions for the fiscal year 2010 program.
It announced that it has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. It continues to accept petitions subject to the general cap.
I can report personally that the most recent H-1B regular cap I-129 petition that I filed was filed on May 11 and it was approved on May 15 � premium processed.
Also, the USCIS announced that is has received approximately 20,000 petitions for aliens with advanced degrees, consistent with its prior update and it reconfirmed that it is still accepting advanced degree petitions because it assumes that not all the petitions it received are approvable.
It�s beginning to look like the cap isn�t going to be reached any time soon and, who knows, maybe not at all this fiscal year.

I see lot of excitement about asking USCIS about filing for I-485
even when visa numbers are unavailable. I am afraid this may
not work.
The ombudsman report 2005 was very critical about temporary EADs being issued to "potential terrorists" without proper background check. Filing for I-485 and getting EAD is like a limbo state btween GC and H1B. This approach may not gain much support.
(1) How about proposing that they should do FBI name check with I-140?
This is the petition for immigrant visa.
(2) Those who have approved I-140 but haven't filed for I485 due to
retrogression can apply for FBI name check separately.
(3) These added "security measures" will boost our chances of getting them OK to file for I-485 even when PD is not current.
p.s
the argument that FBI name check is valid only for a breif period is stupid, but it may be forthcoming. The response is what if some one commits terrorism 6 months after getting GC:D

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:

Hi,
I got H1-B petition (I-797) approved in 2008 but due to recession, I couldn't appear to consulate office. I did not get a chance to work in US for that employer so I don't have any pay stubs for that employer.
The petition is approved till 2011. And now I am planing to either appear for visa stamping or transfering I-797 to any other sponser.
My queries are -
A-Appearing for Visa stamping now after long time is right option or is there any chance of rejection?
B-Since My current employer is not able to employ me there,I want to transfer my I-797. Can It be possible? How much risk is there? If it can be done that what is the process of that please?
C-Since petition is valid till 2011, If I get stamped this year Oct / 2010 what will be duration of visa?
D-Any sponsrs list ?

I received a Biometric Apt. through my attorney a month back and I appeared for the apt. The time was coincided with my move so it went to attorney and didnt come to my address.
Now I received another notice dated one month later than the first one. So I want to talk to them and findout if it necessary to appear again.
