Hi,
My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. The lottery program was established by the State Department back in 1990. Participation in the lottery has grown steadily as people in the developing word have gained increasing access to the internet. The month long enrollment period ended on November 3. Many people apply year after year since there is no limit on the number of times you can apply. The only rule is that only 7% of the winning applicants may come from any one country.

Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT

My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.

Hi Friends,
My H1b 6 years time will expire on March 24th, 2011. One of my previous employer (eData experts) based out of PA had filed for my PERM labor in 12/12/1007.
But unfortunately due to their negligence it was denied and I was only told about only after 3 months. I currently work for another employer and they have not started my GC processing yet. I don't want to work for this new company because of lot of work pressure which is affecting my work life balance. Can someone out there please suggest me the options to stay in this country. This is very urgent. Your suggestions are really valuable for me. Appreciate your time.

I am currently on H1B status with 3 yrs left on my visa. I've used 3 yrs already.
I'm not a project at the moment and if I convert to H4 now, can I continue on the same H1 after a couple of yrs.

This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

I know that this is not a "Green card related" question but an important question that I hope someone will answer. I am planning to use EAD after my I140 approval and jump to consulting business. I have thought about Self-employment but it sounds like it is risky. Are there any good consulting companies which charge very less percentage for having me as an employee on EAD. I hope that company can send AC21 and continue my GC processing.
